Terms of use
These terms govern the use of BrockiMap. In short: BrockiMap is free, we do our best but cannot guarantee anything, and please use the site fairly. In case of doubt, the German version applies.
1. Scope
These terms of use apply to the website brockimap.ch and to any apps of BrockiMap (together «BrockiMap»). The person responsible is named in the legal notice («we»). By using BrockiMap or creating an account, you accept these terms.
2. What we offer
BrockiMap is a free directory of Brockenhäuser in Switzerland with a map, list, filters and, for signed-in users, the option to save Brockis, tick them off and mark favourites.
There is no entitlement to use BrockiMap or to any particular functions. We may change, restrict or discontinue the offer at any time. We try to keep BrockiMap available, but interruptions can occur.
3. Information about Brockis
The information is compiled from public sources and reports. It is provided without guarantee (see the legal notice). Ratings come from Google and reflect the opinions of third parties.
The Brockis are solely responsible for their own offering. BrockiMap is not a party to any purchase, donation or other agreement between you and a Brocki.
4. User account
An account is optional. You need one to save Brockis, tick them off and mark favourites. You can sign in with an email address (with a password or a code) or with Google. To open an account you must be at least 16 years old or have the consent of a parent or guardian.
Keep your password secret and let us know if you suspect misuse. Your saves and visits are visible only to you.
You can delete your account at any time; until a delete button is available, a short email to [email protected] is enough. We may block or delete accounts that breach these terms.
5. Fair use
Please do not submit false or misleading reports, do not use BrockiMap for unlawful purposes, and do not interfere with its operation.
Copying the directory systematically or in bulk, in particular by automated means (scraping, bots), is not permitted without our written consent. Linking to BrockiMap and sharing individual entries is of course welcome.
6. Reports, suggestions and photos
When you send us corrections, suggestions for new Brockis or other information, you grant us the free, non-exclusive right, unlimited in time and place, to use this information for BrockiMap. We decide whether and how we use it. There is no entitlement to publication or compensation. Facts such as addresses and opening hours are not protected by copyright anyway.
Photos: If you upload a photo, the copyright remains with you. You grant us a free, non-exclusive right, unlimited in time and place, to store the photo, adapt it technically (for example crop, reduce in size, compress, correct brightness) and publish it on BrockiMap (website and apps) and in BrockiMap's own channels for the Brocki concerned. We may pass this right on only to a successor that continues BrockiMap.
We name you as the photographer, with your name or a pseudonym of your choice («Photo: …»). If you prefer, the photo can also be shown without a name.
You confirm that you took the photo yourself or are otherwise entitled to grant these rights, and that no rights of third parties are infringed. People must not be recognisable unless they have agreed. Please respect the house rules of the Brocki and ask the staff if in doubt.
We may decline or remove photos without giving reasons. If you ask us to, we will remove your photo from BrockiMap within a reasonable time; copies that were already shared before (for example by others) are beyond our control.
7. Intellectual property
The design, texts and compilation of BrockiMap are protected. Map data are subject to their respective licences, in particular the Open Database License (ODbL) of OpenStreetMap.
8. Liability
BrockiMap is free of charge. To the extent permitted by law, we exclude all liability, in particular for the accuracy of the information, for interruptions and for indirect damage or consequential loss (for example a wasted journey to a closed Brocki). Liability for unlawful intent and gross negligence (Art. 100 of the Swiss Code of Obligations) and any other mandatory liability remain unaffected.
9. Data protection
How we handle personal data is explained in our privacy policy. It is governed by the Swiss Federal Act on Data Protection (FADP).
10. Changes
We may amend these terms. The version published on this page applies. We will inform account holders of significant changes by email or when they next sign in.
11. Applicable law and jurisdiction
These terms are governed exclusively by Swiss law, excluding its conflict-of-law rules. The place of jurisdiction is the registered office or place of residence of the person named in the legal notice, subject to mandatory places of jurisdiction, in particular for consumers (Art. 32 of the Swiss Civil Procedure Code).
12. Severability
Should individual provisions be invalid, the remaining provisions remain valid. The invalid provision shall be replaced by one that comes as close as possible to its purpose.
